Passenger Bus Carriers - Frequently Asked Questions

The Public Service Commission regulates Motor Carriers of Passengers operating "for hire" within the State of Georgia. Carriers transporting passengers must obtain authority from the PSC prior to operations commencing. There are two types of passenger carriers: those that offer charter service and assess charges based on the vehicle and those that charge for each passenger on an individual basis. In order to assist you with determining what type authority you need, below is a list of frequently asked questions.

Which application do I complete to transport passengers?

Q2.

How long does it take to obtain authority?

 

A.

From 6 to 8 weeks for the TR0007.

From 4 to 6 weeks for the TR0009.

 

Q3.

Once I obtain permanent authority, are there any annual costs?

 

A.

Vehicle Identication Stamps are required each year at a cost of $5.00 per vehicle. To obtain vehicle stamps, complete Form IR-1 for each vehicle.

What is the definition of a Charter Service?

 

A.

Charter service is defined as transportation of a group of persons who pursuant to a common purpose, under a single contract, at a fixed charge for the vehicle, have acquired the exclusive use of the vehicle to travel together under an itinerary either specified in advance or modified after having left the place of origin. Carriers that are operating in charter service are required to file a Motor Carrier of Passenger Permit application, but are not required to file a tariff.

Carriers that are operating in charter service are required to file a Motor Carrier of Passenger Permit application, but are not required to file a tariff.

What is a tariff?

Charter service is defined as transportation of a group of persons who pursuant to a common purpose, under a single contract, at a fixed charge for the vehicle, have acquired the exclusive use of the vehicle to travel together under an itinerary either specified in advance or modified after having left the place of origin. Carriers that are operating in charter service are required to file a Motor Carrier of Passenger Permit application, but are not required to file a tariff.

You can find a sample tariff in the forms section. The sample tariff is in the prescribed format and contains the wording required by the PSC Transportation Rules but you may add additional language relevant to the service that your company provides. If you offer service on both a per-passenger basis and charter basis, your charter rates should not be included in the tariff. Tariffs must be typewritten or printed. Once a tariff has been approved, no increases can be made by the carrier in any rates or fares unless thirty (30) days written notice is given to the PSC and a notice posted in a conspicuous place for passengers to review the proposed increase. The department must approve all changes. No rates or fares may be discounted for any reason.

 

Q6.

What about Sport Utility Type Vehicles (SUV)?

 

A.

Stretched SUV's with a seating capacity of 10 to 14 passengers are subject to the SUV Maximum Rate Tariff, found in the forms section, and are not required to file an additional tariff unless other types of vehicles are also in use. SUV's with a seating capacity of 15 and over would be required to file a passenger tariff if passengers are charged on a per-passenger basis.

What if I want to conduct both charter and shuttle passenger service?

You must apply for both the charter passenger permit and the Certificate for the shuttle service.

 

Q8.

Do I need a chauffeur permit for operating a bus?

 

A.

No, a chauffeur permit is required for limousine drivers only.
